Can we legally have a camera(s) record a nanny working in our home?

peru home
John W asked:

Our current AuPair is due to return home. We trust her completely but after reaching the two year max on her visa (J-1) she will return to Peru in late July. We will get another AuPair soon. Child abuse and simple negligence is a concern each time we get a new person to watch the children (We have had two nannies and our current AuPair). We are considering installing cameras in our house. A second question follows, should we tell the employee they may be being observed? Of course we recognize that it would clearly give greater respect for their right to privacy. However any calculated mistreatment could simply happen off camera.

We have heard of systems where you can access live views of your home over a secure internet connection. We have no intention of placing cameras anywhere but the high use areas (kitchen, children’s rooms and a playroom). We have no intention of taping/recording anything.

Yes you can legally have camera(s) to record a nanny working in your home or for that matter anyone that’s in your home. You can record every room in your home if you like including your yard for security reasons.

Yes you can, and it’s legal. You can record in your home, and outside your home (front, and back yards). Just not your neighbors home. And no you shouldn’t tell them about your cameras. Those you install to protect your childrens safety. Why would you risk that by telling them they are there.
is where you’ll find what you’re looking for.

sure you can, its your home, you have all rights! once anyone comes into YOUR home, some of their rights are somewhat taken away, mainly because there are some things that you just dont do in other people homes

Of course you can, and I don’t blame you one bit.

My husband installs alarms and cameras, and their company has a program where you can view any camera at any time, as you mentioned. I think it’s a wonderful idea.

I, personally would not tell the caregiver of the cameras. She will be smart enough to be straight as a pin in the monitored rooms, but you’d never know what may or may not have happened off camera.

Good luck and props to you for being such a caring and proactive parent.

Of course you can, and you should. My question is, why are you not planning on taping or recording anything? Obviously, you cannot be in front of a computer watching her all the time. Plus, if she does something wrong (hurts your child, steals) you will need recorded proof. Wouldn’t you want to make sure she is prosecuted, especially if something physically happens to your child?

It’s your home, sure it’s legal! In my country, the families who hired Indonesia maid mostly have cameras recording them working in the houses. There are a lot of cases which the Indon maid fed the children water with their urine (it’s the maid culture believing that this will make the child listen to her), hit them till fatal injuries and torture the children! It’s safer to have a camera at home.
